These Website Terms & Conditions govern your use of thehumanimpactproject.com and any services, bookings, registrations or purchases made directly through this website.

The Human Impact Project is a registered Australian business. By accessing or using this website, submitting an enquiry, making a booking or purchasing a service through the website, you agree to these Terms to the extent they apply to your interaction with us.

If you do not agree with these Terms, you should not use the website or purchase services through it.

What The Human Impact Project provides

The Human Impact Project provides education, professional learning and capability development across areas including workplace wellbeing, human performance, leadership, psychosocial safety, self-awareness, emotional regulation, communication, Mental Health First Aid, education and community development.

Services may include:

  • keynote presentations and speaking engagements;
  • workshops and facilitated professional learning;
  • workplace and education programs;
  • Mental Health First Aid training;
  • digital and microlearning resources;
  • events and community education;
  • organisational capability development; and
  • related educational resources and services.

The availability, format and scope of services may change from time to time.

Not every service described on this website is necessarily available as an immediate online purchase. Some services are designed or configured in consultation with the organisation or client.

Information published on this website is provided for general educational and informational purposes.

While we take reasonable care to provide accurate and evidence-informed information, website content is not intended to be a substitute for advice tailored to your individual or organisational circumstances.

Nothing on this website constitutes medical, psychological, counselling, legal, financial, industrial relations, workplace health and safety or other regulated professional advice.

The Human Impact Project does not provide clinical healthcare through this website.

Where information relates to mental health, wellbeing, stress, neuroscience, psychosocial safety or workplace risk, organisations and individuals remain responsible for obtaining appropriately qualified professional advice where required.

Workplace and psychosocial safety information

The Human Impact Project provides education relating to human factors, self-awareness, wellbeing, communication, leadership and psychosocial safety.

Our services are intended to complement good organisational systems and practices. They do not replace an employer's or organisation's responsibilities under applicable workplace health and safety, employment, industrial relations, workers' compensation, discrimination or other laws.

Organisations remain responsible for identifying, assessing, controlling and reviewing workplace risks and for meeting their legal and regulatory obligations.

No Human Impact program, keynote, workshop or resource can guarantee the prevention of incidents, psychological injury, workplace conflict or other organisational outcomes.

Mental health information

Some website content and services discuss mental health, stress, emotional wellbeing and related topics.

This information is educational and is not diagnosis, treatment, psychotherapy, counselling or crisis care.

If you or another person requires individual mental health or medical support, you should seek assistance from an appropriately qualified health professional or relevant service.

Participants should not rely on Human Impact educational content as a substitute for professional healthcare.

Mental Health First Aid training

Mental Health First Aid courses offered through The Human Impact Project are delivered by a licensed Mental Health First Aid Instructor using programs developed by Mental Health First Aid International / Mental Health First Aid Australia (MHFAI).

The Human Impact Project is responsible for facilitating the course it has been engaged to deliver. Mental Health First Aid course materials, curriculum, participant systems, assessments, certificates and associated intellectual property may be owned or administered by MHFAI.

Participation may therefore also be subject to relevant MHFAI requirements, policies and terms.

Completion of Mental Health First Aid training does not qualify a participant to diagnose, treat or provide professional mental health care.

Enquiries and introductory conversations

Submitting an enquiry or booking an introductory conversation with The Human Impact Project does not create a contract for services.

Initial conversations are intended to help us understand your context, the challenge or opportunity you are exploring and whether Human Impact may be an appropriate fit.

Following a conversation, we may recommend a service, request further information, prepare a proposal, recommend another provider or determine that we are not the appropriate provider for the work.

Neither party is obligated to proceed simply because an enquiry or introductory conversation has occurred.

Formation of a service agreement

For tailored services such as keynotes, workshops, workplace programs, education programs or consulting engagements, the specific terms of the engagement may be set out in a proposal, quote, booking agreement, statement of work or other written agreement.

A contract may be formed when, depending on the circumstances:

  • you accept a written proposal or agreement;
  • you confirm acceptance of quoted terms;
  • you make a required payment or deposit;
  • you purchase a service through our online checkout; or
  • both parties otherwise clearly agree to proceed.

Where a separate proposal or service agreement contains terms that differ from these Website Terms, the specific service agreement will apply to that engagement to the extent of the inconsistency.

Online bookings and purchases

Some services, including selected Mental Health First Aid courses, may be available for direct registration or purchase through the website.

You are responsible for providing accurate and complete information when making a booking or purchase.

A booking is not confirmed until any required payment has been successfully processed and you have received confirmation from us or the relevant booking system.

We may contact you if additional information is reasonably required to administer or deliver the service.

Prices, GST and payments

Unless otherwise stated, prices displayed on the website are in Australian dollars (AUD).

The website, checkout, proposal or invoice will indicate the amount payable and any applicable GST.

Online payments may be processed securely by Stripe or another payment provider identified at checkout.

The Human Impact Project does not directly store complete credit or debit card numbers submitted through Stripe.

For services that are not purchased through the website, payment arrangements will be set out in the applicable proposal, invoice or service agreement.

Cancellations, transfers and refunds

Cancellation, transfer and rescheduling arrangements may vary according to the type of service being purchased.

Where specific cancellation or transfer terms apply to a course, event, keynote, workshop or program, those terms will be provided on the relevant booking page, checkout, proposal, confirmation or service agreement.

Any specific cancellation policy operates in addition to your rights under the Australian Consumer Law and does not exclude or restrict rights that cannot lawfully be excluded.

A change of mind does not automatically give a customer a right to a refund under Australian Consumer Law, although we will honour any additional cancellation or transfer rights that we expressly offer.

If The Human Impact Project must cancel a prepaid public course or event and cannot provide a reasonable alternative or rescheduled date acceptable in the circumstances, affected customers will be offered an appropriate remedy, which may include transfer or refund of the affected service.

Tailored organisational engagements may have different cancellation arrangements because dates may be reserved specifically for the client and preparation, travel or other costs may already have been incurred. Those conditions will be disclosed in the applicable service agreement.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where the Australian Consumer Law applies, services come with statutory guarantees including that they will be provided with due care and skill and, where applicable, be fit for an agreed purpose and supplied within a reasonable time.

If a service does not comply with an applicable consumer guarantee, you may be entitled to remedies provided by law.

Nothing in these Terms should be interpreted as a blanket "no refunds" policy or as limiting rights available under Australian Consumer Law.

Changes to scheduled services

Occasionally circumstances outside our reasonable control may affect a scheduled course, event, workshop or service.

Where reasonably necessary, we may change matters such as a delivery time, venue, delivery format or facilitator arrangements.

We will take reasonable steps to minimise disruption and notify affected participants or clients.

If a material change means we can no longer provide substantially the service that was purchased, we will work with the affected customer to provide an appropriate alternative or remedy consistent with applicable law.

Participant conduct

We aim to create learning environments that are respectful, safe and constructive.

Participants attending Human Impact events, workshops or training are expected to behave respectfully toward facilitators, other participants, venue staff and members of the community.

We may take reasonable action where conduct is abusive, threatening, discriminatory, unsafe or materially disruptive to the learning environment. This may include asking a person to stop the conduct or, where necessary, leave a session.

Any decision relating to fees or refunds in those circumstances will be considered reasonably in light of the circumstances, any applicable booking terms and Australian Consumer Law.

Educational outcomes

Learning is influenced by many factors outside the control of The Human Impact Project.

While our services are designed to increase understanding and capability, we do not guarantee particular personal, educational, workplace, financial, health, safety, cultural or performance outcomes.

Examples, case studies, research findings and organisational outcomes discussed on the website are provided for educational purposes and should not be interpreted as a guarantee that the same result will occur for another individual or organisation.

Research and evidence

The Human Impact Project draws on research across fields including psychology, behavioural science, neuroscience, physiology, education, mental health, wellbeing and human performance.

Scientific knowledge develops over time, and research findings can differ in quality, context and interpretation.

We take reasonable care to distinguish established evidence from emerging concepts where relevant, but website content should not be treated as a comprehensive academic, clinical or regulatory assessment of a topic.

Research summaries and commentary published through the Human Impact Research Library are educational interpretations and do not replace reading the original research or obtaining appropriate professional advice.

Intellectual property

Unless otherwise identified, the content created by or for The Human Impact Project is owned by or licensed to The Human Impact Project and is protected by applicable intellectual property laws.

This may include:

  • articles and written content;
  • program and keynote material;
  • frameworks and models;
  • diagrams and illustrations;
  • worksheets and activities;
  • videos and digital learning materials;
  • presentation materials;
  • training resources;
  • logos, branding and graphics;
  • program and product names; and
  • other original educational material.

This includes proprietary Human Impact concepts and materials made available through our services.

Third-party materials remain the property of their respective owners.

You may view website material and share links to publicly available pages for ordinary personal or professional reference.

You must not, without prior written permission:

  • reproduce substantial website or program content;
  • copy or republish our training materials;
  • record or reproduce a keynote, workshop or course;
  • modify our materials and present them as your own;
  • use our frameworks or resources to provide commercial training;

Mental Health First Aid intellectual property

Mental Health First Aid course content, manuals, branding, curriculum and related materials are owned or controlled by Mental Health First Aid International or relevant licensors.

Participation in a Mental Health First Aid course does not transfer ownership of that intellectual property or grant permission to reproduce or commercially deliver MHFA content except where separately authorised by MHFAI.

Photography, recordings and course materials

Participants must not record, reproduce, livestream or commercially distribute keynotes, workshops, courses or proprietary training materials without prior written permission.

Where The Human Impact Project intends to photograph or record participants for promotional, educational or other purposes, appropriate notice and consent arrangements will be used where required.

Specific event conditions may provide further information about photography or recording.

This website may contain links to external websites, research publications, payment systems, booking platforms, video-conferencing services or other third-party services.

These may include services such as Calendly, Stripe, Zoom, Mental Health First Aid Australia and external research sources.

Changes will apply prospectively from the date they are published, unless another date is stated or applicable law requires otherwise.

Where you have already entered into a separate service agreement with us, later changes to these Website Terms will not retrospectively change the agreed commercial terms of that engagement unless both parties agree or the law requires it.

Governing law

These Terms are governed by the laws applying in Western Australia, Australia.

Subject to any rights that cannot lawfully be restricted, disputes relating to these Website Terms will be dealt with by courts and tribunals having jurisdiction in Western Australia.

Nothing in this provision limits any right a consumer may have to bring a matter in another jurisdiction where applicable consumer law permits.
